Article 2 — Purpose and Scope

These terms and conditions govern all distance sales concluded on this site. They apply to consumers as defined by the Consumer Code, acting on their own behalf.

We deliver to Metropolitan France and Corsica, Monaco, the French overseas departments and territories we serve, Belgium, the European Union, Switzerland, and various international destinations. The up-to-date list of destinations and rates can be found on the Delivery page.

Validation of an order constitutes acceptance of the terms in force on that date. These may be modified at any time; the applicable version is the one displayed on the day of the order. You may save or print them.

Article 3 — Products

The essential characteristics of each item are listed on its product page. Photographs are as accurate as possible but do not constitute a contractual commitment regarding the exact rendering of colors, which varies according to screens.

Our items are also offered in our Lyon boutiques. An item may therefore be sold in-store between your order and its preparation. In such a case, we do not immediately give up: we check our network and our suppliers in Italy to find the piece in your size. You will be kept informed of our research and its timeline. If the piece remains unavailable, we will offer you an equivalent item or proceed with a full refund, at your choice.

Article 4 — Pricing

Prices are indicated including all taxes, excluding delivery costs. For deliveries within the European Union, the applicable VAT is that of the destination country. For Switzerland and destinations outside the European Union, prices may be displayed in local currency, converted at the daily rate; VAT and any customs duties are payable by the recipient upon delivery and are not covered by us.

The total amount due, including delivery costs, is summarized before final validation of the order.

Article 5 — Ordering

You verify the details of your order and correct any errors before validating it. Validation constitutes acceptance. We acknowledge receipt by electronic means. The sale is final upon the dispatch of the shipping confirmation.

We reserve the right to refuse an abnormal order, one clearly placed in bad faith, or one coming from a customer with whom a payment dispute is ongoing.

Article 6 — Payment

Visa, Mastercard, and Carte Bleue cards, PayPal, Apple Pay, and Shop Pay wallets.

Payment in installments is offered at checkout, with no additional fees if installments are paid on the scheduled dates. Details of installments and amounts are presented before any validation. This facility is subject to the approval of our financing partner and may not be offered on certain orders.

Payment data is processed in a secure environment by our service providers and is not accessible to us. We do not store any card numbers.

The account is debited during order preparation. In case of authorization refusal, the order is cancelled.

Article 7 — Delivery

Deadlines, rates, and carriers are detailed on the Delivery page. Orders validated before 3 PM Monday to Friday are shipped the same day, subject to availability. We do not ship on Saturdays, Sundays, or public holidays.

Except in exceptional circumstances, delivery occurs at the latest thirty days after the order. Beyond this period, and after a formal notice has remained ineffective, you may terminate the contract and be refunded within fourteen days.

If the package shows an anomaly upon receipt, open it in the presence of the carrier and record precise reservations on the delivery note.

Article 8 — Right of Withdrawal

You have fourteen days from receipt to exercise your right of withdrawal, without having to provide justification.

To exercise it, inform us via an unambiguous declaration: from your customer account, by email to contact@imperial-lyon.fr, or by mail. You may use the standard form provided at the end of these conditions.

Return the items at the latest fourteen days after having informed us. Return costs are at your expense. Choose a tracked shipment: we are not responsible for packages lost during return.

We will refund you no later than fourteen days after receiving the items, or after proof of their shipment if it reaches us sooner, using the same payment method used for the order. The refund covers the price of the items and the standard delivery costs initially paid.

Article 9 — Condition of Returned Items

You may try on items as you would in a boutique. Each garment is delivered with a numbered seal that allows for this fitting; we ask you not to remove it until you are certain of keeping the piece.

In accordance with Article L221-23 of the Consumer Code, your liability may be incurred in the event of depreciation resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the item. A garment that has been worn, washed, stained, damaged, or lacks its original tags will result in a deduction proportionate to the loss of value.

Pack the parcel carefully. Do not use the item's box as a shipping parcel: it is part of the product. Imperial and Please protective pouches must be returned; otherwise, €5 per missing pouch will be deducted.

Article 10 — Exchange

Independently of the right of withdrawal, we accept exchanges within fourteen days of receipt, subject to stock availability. Indicate "exchange" as the reason, specifying the desired size or color. Outbound and return shipping costs remain at your expense. In-store, exchanges are possible upon presentation of the invoice.

Article 11 — Legal Warranties

All our items benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

The conformity guarantee is valid for two years from delivery. You choose between repair or replacement, and you are exempt from proving the existence of the defect during these two years. It applies independently of any commercial warranty.

The hidden defects guarantee allows you to obtain the cancellation of the sale or a price reduction, within a period of two years from the discovery of the defect.

If an item is defective or non-compliant, contact us before any return. Return and re-shipment costs will then be covered by us.

Article 12 — Complaints and Consumer Mediation

For any complaint, write to us at contact@imperial-lyon.fr or call 09 71 56 59 66. We commit to responding within fifteen days.

In accordance with Articles L612-1 et seq. of the Consumer Code, if your written complaint has not resulted in a satisfactory solution, you may use the consumer mediator we are affiliated with free of charge:

CM2C
49 rue de Ponthieu, 75008 Paris
Phone: 01 89 47 00 14
Website: www.cm2c.net/declarer-un-litige.php
Email: litiges@cm2c.net

The mediator can only be contacted if you have previously sent us a written complaint, and within one year of that complaint. Recourse to mediation is free for the consumer and does not exclude recourse to the courts.

Article 13 — Personal Data

The data collected is necessary for processing your order, managing your account, and, with your consent, sending our commercial information. The data controller is BOUTIQUE 1 SAS.

In accordance with the General Data Protection Regulation and the French Data Protection Act, you have the right to access, rectify, erase, limit, oppose, and port your data. Exercise these rights at contact@imperial-lyon.fr or by mail to the registered office. You may lodge a complaint with the CNIL.

You can unsubscribe from our communications at any time via the link provided in each message.

Article 14 — Cookies

This site uses cookies necessary for its operation, as well as audience measurement cookies and, if applicable, advertising personalization cookies. You set your preferences during your first visit and can modify them at any time.

Article 15 — Intellectual Property

The trademarks, texts, photographs, and graphic elements of the site are protected. Any reproduction or use, in whole or in part, without prior written authorization, is prohibited.

Article 16 — Force Majeure

Our obligations are suspended in cases of force majeure. If the impediment continues beyond fifteen days, you may terminate the order and be refunded.

Article 17 — Applicable Law

These conditions are subject to French law. If you reside in another Member State of the European Union, you retain the benefit of the mandatory provisions that are more protective of your country of residence.

In case of dispute, an amicable solution will be sought as a priority, in particular through the mediation provided for in Article 12.
